The 2019 SECURE Act created PEPs, as well as outlined duties and responsibilities for both the Pooled Plan Provider (P3) and adopting employers. An uniformed yet somewhat widely held belief is that an adopting employer to a PEP can “set-it-and-forget-it” as all responsibility passes to the P3. Nothing could be further from the truth.
While a PEP option may reduce fiduciary liability exposure for an employer, the PEP adopting employers remain “limited-scope” fiduciaries when joining a PEP. This means that besides prudently choosing a PEP for their plan participants they must consistently monitor the activities of both the P3 and the PEP. Not doing so places the employer in jeopardy of violating edicts of ERISA.
